1. About These Terms

These Terms of Use (the "Terms") are an agreement between the Shopify merchant accepting them ("you" or the "Merchant") and EvoLabs, a registered entrepreneur in the Republic of Serbia ("EvoLabs", "Mapstore", "we", "us", or "our").

The Terms govern your access to and use of the Mapstore Shopify application, its storefront components, website, help content, and related services (together, the "Service"). By installing, accessing, or using the Service, you accept these Terms and confirm that you have authority to bind the Merchant. If you do not agree, do not use the Service.

Our Privacy Policy and Refund Policy also apply. Shopify's own terms govern your Shopify account and its platform.

2. The Service

Mapstore helps merchants publish and manage store locations, product availability, map search, filters, lead forms, imports, syncing, and usage insights. Available features and capacity depend on the plan selected by the Merchant.

We may improve, update, or change the Service. If a change materially reduces a paid feature, we will provide reasonable notice when practical. We do not promise that every feature will remain available indefinitely.

3. Shopify Account and Access

You must maintain an active Shopify store and give the Service the Shopify permissions needed for its features. You are responsible for your Shopify account, staff permissions, and all activity performed by people authorized to access the App for your store.

You must provide accurate information and promptly notify us at [email protected] if you suspect unauthorized access to the Service.

4. Plans, Charges, and Renewal

Mapstore offers a free plan and paid subscription plans. Current prices, billing intervals, features, and limits are shown in the App, on the Mapstore website, or on the Shopify App Store. Prices are shown in US dollars unless stated otherwise, and applicable taxes may be added by Shopify.

Paid plans renew monthly or annually until changed or cancelled. Before billing begins, Shopify displays the subscription terms and requires approval from a Merchant user with the necessary permissions. Shopify processes subscription charges, invoices, and payment collection.

You can change your plan through the App's billing page or uninstall the App through Shopify. Plan changes and cancellation take effect as shown during the Shopify billing flow. A charge already added to an upcoming Shopify invoice may still appear after cancellation. Refunds are governed by our Refund Policy.

5. Merchant Content and Data

You retain ownership of location records, images, custom fields, product references, lead-form configuration, and other content you submit to the Service ("Merchant Content"). You grant us a non-exclusive, worldwide licence to host, copy, process, transmit, and display Merchant Content only as needed to provide, secure, support, and improve the Service.

You are responsible for the accuracy and legality of Merchant Content and for having all rights and permissions needed to provide and publish it. You must maintain any privacy notice, consent, or other legal basis required for information collected through your storefront, including lead forms.

6. Acceptable Use

You must not use the Service to:

  • break any law or infringe another person's rights;
  • publish unlawful, deceptive, harmful, or malicious content;
  • introduce malware or interfere with the Service, its users, or its infrastructure;
  • bypass security, access controls, plan limits, or technical restrictions;
  • probe or access systems or data without authorization, or abuse Service endpoints through excessive automated requests; or
  • copy, reverse engineer, resell, or commercially exploit the Service except where applicable law does not allow that restriction.

7. Third-Party Services

The Service depends on Shopify and may connect with services such as Google Maps, Google Places, Google Sheets, OpenStreetMap, OpenFreeMap, email providers, and other infrastructure providers. Your use of a third-party service is also subject to that provider's terms and privacy practices. You are responsible for third-party accounts, credentials, usage limits, and charges that you choose to use with Mapstore.

We are not responsible for changes, errors, or outages caused by a third-party service outside our reasonable control.

8. Accuracy and Availability

You are responsible for reviewing store details, opening hours, product availability, directions, ratings, geocoding results, and synced data before relying on or publishing them. Map and third-party data may be incomplete, delayed, or inaccurate.

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation. We do not provide a service-level guarantee.

9. Intellectual Property and Feedback

EvoLabs and its licensors own the Service, including its software, design, branding, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your Shopify business while your account remains in good standing.

If you send suggestions or feedback, you allow us to use them without restriction or payment. This does not give us ownership of Merchant Content.

10. Suspension and Termination

You may stop using Mapstore at any time. We may suspend or terminate access if you materially breach these Terms, fail to pay an approved charge, create a security or legal risk, or if Shopify requires us to do so. Where reasonable, we will give notice and an opportunity to correct the issue.

Before uninstalling, export any data you want to keep. After termination, access to the Service ends and we handle retained data as described in the Privacy Policy. Terms that by their nature should survive termination, including ownership, disclaimers, liability, indemnity, and governing law, will continue to apply.

11. Limitation of Liability

To the maximum extent permitted by law, EvoLabs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from the Service.

To the maximum extent permitted by law, EvoLabs' total liability for all claims relating to the Service will not exceed the subscription fees you paid for Mapstore during the 12 months immediately before the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

12. Indemnity

To the extent permitted by law, you will indemnify and hold EvoLabs harmless from third-party claims, damages, and reasonable costs arising from your Merchant Content, your unlawful use of the Service, or your material breach of these Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-law rules. The courts with jurisdiction in Belgrade, Serbia will have exclusive jurisdiction over disputes relating to these Terms or the Service, except where mandatory law requires otherwise.

14. Changes to These Terms

We may update these Terms from time to time. We will update the "Last Updated" date and, for material changes, provide reasonable notice through the App, by email, or by another appropriate method. Your continued use of the Service after the updated Terms take effect means you accept them.

15. General

These Terms, together with the policies linked above, are the entire agreement about the Service. If one provision is unenforceable, the remaining provisions stay in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them as part of a reorganization, merger, sale, or transfer of the Service.
